Is tree felling allowed by regulations?
Under Forestry
Minister Regulation Nomor P.14/Menhut-II/2011 Year 2011 Concerning Timber
Utilization Permit (“WUP”), WUP’s holder is entitled to undertake tree felling
in accordance with granted permits. In
other words, tree felling shall be allowed as far as WUP is possessed.
Various licenses required
1. Timber Utilization Permit
WUP is permit to utilize timber and/or non-timber originated from following regions:
- Production forest which is able to be converted and released (HPK), namely forest that the space is reserved in order to use in development area outside forestry activities
- Production forest in form of forest area swapping, namely production forest changes and/or limited production forest into non forestry area which is compensated to include the additional area from non-forestry area to forestry area;
- Utilization of forestry area on production forest or conservation forest with land-use, namely utilization over forestry area partly to other parties in order to development interest outside forestry activities without changing status, allocation and forestry area’s function;
- Another Area of Use which has been granted allocation permit, namely forestry areal granted under Minister of Forestry Decision concerning forestry areal appointment and province waters or in accordance with Forest Land Use Agreement into non-forestry areal.

permit holder shall report to Head of Service Office in Province. Prior to the regulation concerning WUP come
into existence, equipment procurement required other permits. However, the relevant regulations have been
revoked and invalid. Thus, equipment procurement for Another Area of Use is no longer necessary another permit.
For uneconomical timber
utilization is not required WUP and able to undertake activities such as land
clearing and tree felling. Uneconomical
terms define as stand volume which in diameter more than 30 centimeters and
maximum 50 meters cubic in one probable WUP. The potential timber
still imposes obligation to pay the
compensation of stumpage value in accordance with timber cruising result
with intensity of 100 % for timber in diameter more than 30 centimeters
conducted by Service Office in Regency/City. The potential timber is issued The
Letter from Head of Service Office in Regency/City.
2. Corridor Establishment Permit and Corridor Usage Permit
Corridor is road
transportation which takes form in land road, canal, lorries/rail, etc. which establishes
and/or uses to carry timber or non-timber, industrial production of primary timber and
non-timber from Business License Timber Management (IUPHHK)
in natural
forest or IUPHHK in plantation forest or WUP or
primary industrial area of forest products to log pond in riverside/sea or elsewhere through the
forest outside IUPHHK/Business
License Non-Timber Management in natural forests or plantations in
the WUP or the area of
primary forest products industry
is concerned.
Corridor
Establishment Permit is permit granted by authorities to holder of IUPHHK in
natural forest, IUPHHK in plantation forest or WUP to establish and use road
transport of timber outside the permit areal.
Corridor Establishment Permit may be granted to production forest region
and Another Area of Use.
Corridor Usage Permit
is permit granted by authorities to holder of IUPHHK in natural forest, IUPHHK
in plantation forest or WUP to use existing corridor and no permit holder. Corridor
Usage Permit may be granted to production forest region, conservation forest
region and Another Area of Use.
3. Certificate of Origins (SKAU)
Validity
Certificate of Forest Products is documents which is legality evidence of
forest products on each activities segment in the management of forest. Each carriage, control, possession of
forest products originated from state forest shall complement jointly with SKAU which is valid and used to
carry the forest products in Indonesia. Everyone
is prohibited to carry, control and possess without Validity Certificate of Forest Products in accordance with
article 50 paragraphs (3) point h The Law No. 41 Year 1999 Concerning Forestry.
SKAU utilization is
intended for the distribution order of timber originated from forest rights and
to protect society rights in its transportation. SKAU is used to transport logs and
processed wood which is directly transport from forest rights
or people land. SKAU issued by the Head of Village/Ward
or equivalent officer/other
officials in the village where
the timber will be transported.
SKAU document the use intended for the
circulation order timber from the forest rights,
and to protect
the public in its
transportation. SKAU used to transport logs
and processed wood people who were
transported directly from the
forest or community
land rights.
